Industry voice on prompt payment regulation advisory council

Regulations that will fill out new prompt payment legislation are expected to be ready late this year or early next spring, allowing for the new rules to be implemented.

The heavy construction industry will be represented by Richard Wilson, President of MD Steele and member of the MHCA Board of Directors, on the Manitoba Builders’ Liens Modernization Advisory Council.

Prompt payment rules were included in the Bill 38: the Builders’ Liens Amendment Act, which received Royal assent in the legislature on May 30. The advisory council is to deliver recommendations for regulations attached to the Act, to Consumer Protection and Government Services Minister James Teitsma. When regulations are complete, the Act will come into effect.

The council is to begin its work late summer and into the fall, with a plan for regulations to be made late this year, into spring 2024.

“We are looking forward to completing the work on workable, effective prompt payment rules to ensure each party to a construction projects sees fair, reasonable provisions for payment,” MHCA President & CEO Chris Lorenc said.

Lorenc has been named an alternate for the heavy construction industry on the advisory council.
